1. Introduction

Welcome to GuTravel (hereinafter referred to as "we", "us", "our", or "the Application"). We are committed to protecting the privacy and security of the personal information of our users ("you"). This Privacy Policy describes how we collect, use, share, and protect your personal information when you use our GuTravel mobile application and related services (collectively, the "Services").

By downloading, accessing, or using our Services, you agree to the collection and use practices described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use the Services.

2. Information We Collect

We collect different types of information in connection with the Services, including:

  • Information You Provide Directly:

    • User Content: Photographs you upload to the Application for processing, as well as the filters or prompts you select to guide the generation of the travel guide. Please note that photographs may contain metadata, including geolocation data if enabled on your device.

    • Location Data (with your permission): If you grant explicit permission to the GuTravel Application to access your device's location, we will collect geolocation information (which may be precise or approximate, depending on the permissions granted and available technology). We use this information to provide location-based functionalities, such as helping identify the location of your photograph or contextualizing the generated travel guide.

    • Account Information: To create and manage your account, we collect registration information. This varies depending on the login method:

      • Login with Google or Apple: We receive your name, email address, and a unique identifier provided by Google or Apple. We do not receive your Google or Apple password.

      • Login with Email and Password: We collect your email address and the password you set (stored securely using hashing).

 

  • Payment Information: If you make purchases within the Application, the transactions are processed by Apple "In-app Purchase". You will provide your payment information directly to Apple. We do not collect or store your full payment card details, although we do receive transaction information (payment confirmation, amount, product purchased) necessary to manage your purchase and account.

  • Communications: If you contact our customer support or send us feedback, we may keep a record of that communication.

 

  • Information Collected Automatically:

    • Usage and Device Data (via Google Analytics): We collect information about how you interact with our Services, including the features you use, the actions you take, and the frequency and duration of your activities. We also collect information about the device you use to access the Services, such as the hardware model, operating system and version, unique device identifiers, mobile network information, and application crash data (crash reports). This information is primarily used in an aggregated and anonymized form to analyze trends, administer the Services, improve the user experience, and diagnose technical problems.

    • Information for Advertising (via Google AdMob): To display advertisements within the Application and allow you to obtain tokens, we use Google AdMob. AdMob may collect and use advertising identifiers (such as IDFA on iOS or Advertising ID on Android), IP address, device information, and information about your interaction with the ads shown. You can manage your personalized advertising preferences through your mobile device settings.

    • Processing History (stored in Supabase): We maintain a record of the photographs you have processed and their location (if you have granted permission in the application), and the generated travel guides associated with your account so you can access them later through the history feature of the Application.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and maintain the Services: Process your photographs and prompts via the Gemini API to generate travel guides; manage your account and authenticate your access; store and display your processing history.

  • Improve and personalize the Services: Analyze Application usage (through Google Analytics) to understand user needs, enhance functionality, fix errors, and optimize performance.

  • Display Advertising: Integrate ads through Google AdMob to fund the Services and offer you the possibility to earn tokens.

  • Process Transactions: Facilitate in-app purchases via Apple and manage the acquired plans or functionalities.

  • Communicate with you: Respond to your support inquiries, send you important notifications about the Services (updates, policy changes, security alerts).

  • Security and Legal Compliance: Protect the security and integrity of our Services and users; comply with applicable legal obligations, respond to legal requests or court orders.

4. How We Share Your Information

We do not sell your personal information. We may share your information with third parties only in the following circumstances:

  • Service Providers: We share information with third-party vendors who perform services on our behalf:

    • Google (Gemini API): We send the selected photographs and prompts for processing and generation of the travel guide. Google's use of this information is subject to its own policies.

    • Supabase: We use Supabase as our backend and database platform to store your account information, processing history (photos and guides), and manage authentication.

  • Legal Requirements: We may disclose your information if we believe in good faith that it is necessary to comply with a legal obligation, protect our rights or property, prevent fraud, or protect the safety of our users.

  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, your information may be transferred as part of that transaction.

5. Legal Basis for Processing (for EEA/UK Users)

If you are located in the European Economic Area (EEA) or the United Kingdom, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it:

  • Performance of a Contract: Much of our processing is necessary to fulfill our contract with you (i.e., the Terms of Service to provide GuTravel).

  • Legitimate Interests: We process certain information based on our legitimate interests (or those of a third party), such as improving and securing our Services, conducting analytics, and displaying contextual ads, provided that your fundamental rights and freedoms do not override such interests.

  • Consent: For certain activities (such as personalized advertising, if applicable and explicit consent is required, or certain cookies/tracking if relevant), we will rely on your consent. You may withdraw your consent at any time.

  • Legal Obligations: We may process your information to comply with our legal obligations.

6. Data Storage, Security, and Retention

  • Method and Place of Processing: The processing of your Personal Data is carried out using computers and/or IT-enabled tools, following organizational procedures and modes strictly related to the purposes indicated. Data is processed primarily at the data centers of our service providers (such as Supabase, Google Cloud) and in any other place where the parties involved in the processing are located. Since we and our providers operate globally, your information may be transferred to, stored, and processed in countries outside of your country of residence, including the United States, where data protection laws may differ. We implement safeguards (such as Standard Contractual Clauses, where applicable) to protect international data transfers as required by applicable law.

  • Security: We have implemented appropriate technical and organizational security measures designed to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. This includes, among others, password encryption and the use of secure connections. However, no electronic transmission or storage system is completely secure. We cannot guarantee the absolute security of your information.

  • Retention: We will retain your personal information for as long as your account is active or as needed to provide you the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Once the applicable retention period expires, Personal Data shall be deleted or anonymized. Therefore, the right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the expiration of the retention period.
    When you delete your account, we will take steps to delete your personally identifiable information within a reasonable timeframe, subject to any legal retention requirements or the need to retain aggregated or anonymized data.

  • The right to access, correct, update, or request deletion of your information.

  • The right to object to processing based on legitimate interests or for direct marketing.

  • The right to request restriction of processing of your information.

8. Children's Privacy

Our Services are not directed to individuals under 13 years of age (or 16 in certain EU jurisdictions). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without verifiable parental consent, we will take steps to delete that information from our servers. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us.

9. Legal Actions

The User's Personal Data may be used for legal purposes by GuTravel in Court or in the stages leading to possible legal action arising from improper use of this Application or the related Services.
You declare to be aware that GuTravel may be required to reveal personal data upon request of public authorities.

10. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify you through the Application or by other means (such as email, if we have it) before the change becomes effective. We encourage you to review this Privacy Policy periodically for the latest information on our privacy practices. The "Effective Date" at the top indicates when it was last modified.
